  • landlord wont fix falt - what can i do?

    hi,

    does anyone know legally what i can do

    my landlord will be collecting my rent tomorrow, fine but for 3 months he has been fixing a leak in the roof that drips into my room and he has still had nothing done. can i withhold my rent until he sorts it?

    if im keeping my side of the deal ie paying my rent then i would imagine that he shoud keep his side ie maintenance on the flat.

    any answers would be great

    and i dont have a copy of my contract however i am going to ask him to bring a copy i can keep with him tomorrow

    you definitely need to get a copy of your contract to find out exactly who is responsible for fixing things like that. if it is his and you've been asking him then yeah i wouldn't pay my rent as he's not keeping to his contract.

      Yeah you need to check your lease. Unfortunately as tenants you have very little rights - I found this when my letting agents last year were being absolutely useless.

      Withholding rent is always a bit dangerous though as if you don't pay rent he can evict you. I'd just pester him and point out that he's not keeping to the agreement in the lease - assuming that it's in the lease. If it's not then I don't know what you can do about it I'm afraid - maybe get on to the council and compain?

      Does no one in your house/flat have a copy of the lease? I don't want to nag, but it's really a good idea to read it thoroughly and take a copy of it when you sign it!

        Yeah, I've had the same problem. If he's responsible for fixing problems and doesn't do it, you could refuse to pay rent, although this isn't legally justified. However, if he's already breaching his...then you could consider it. Write to him explaining why you're not going to pay, thats probably the best idea as it puts the onus on him.

        Or what you could do is just refuse to pay the last few months rent - the landlord will kick up a fuss but there's little he can really do.

          i've never had any problems with landlords. we call them up to do silly things like put up shelves and move the fridge. and they replace anything we say is broken.

          basing it on ym expereice, i would think your landlord is responsible for the roof. you need to be more assertive

            cheers for your replies people.

            I just wasnt sure how to deal with the situation as i have rented off a really nice landlord for the last three years who used to come round and change light bulbs because we had high ceelings and bleed the radiators and things so now the new 1's an arse hole i wasnt sure what to do.

            one of the girls next door had a copy or the lease so she's photocopying it for me.

                My boyfriend and I rent through an agency and they are rubbish, we have hadlots of problems with them, mostly the fact that they just come round and try and get in the flat whenever they want without asking, we therefore felt that our contract had been breached so we changed the locks, witheld the amount of rent it cost for the locks and sent them a reciept. We have not given them a key to our flat, they have since tried coming round three times, we were threatened by the landlord, but we knew that the landlord and the agency had very little power in this situation and we told them to take us to court! They didn't take us to court, in fact the landlord wrote a letter agreeing that we could keep the situation as it was.

                My advice to you is....

                Write to you landlord, stating what you want done and by which date, explain if this does not happen that you will be witholding enough rent to cover the cost of the repair and will send him a reciept (make sure this is a photocopied reciept if it gets that far). The fact of the matter is that landlords have very little power in these situations, they might throw their weight around, but even if it came to trying to evict you, it would take at least 3 months! I think by writing to him and by outlining what you expect (include points from the contract if possible) and having it in wiriting, will give you a much greater power, you could even have it signed and witnessed by someone else as evidence of the letter being sent etc. I think this is perfectly reasonable.

                  could always start off with a friendly reminder though rather than shoving legal documents in his face and threatening him though :/ (or her?)

                    pink angel - i know exactly how that feels, its shit isnt it? im going to wirte him a letter, it wouldnt bother me so much but it drips constantly and is quite loud so i havnt had a full nights sleep in 3 months because it comes from the shower and i live with 4 other people so it gets used constantly.

                    shyboy - cheers, i have tried being nice tho, iv been nice for three months and nothing has happened so its time to start being serious i think.

                      Try the askTheSite section of this website. It is staffed by Shelter advisors- they are the housing law specialists and will give you the most accurate advice.

                      You can withold your rent, but you are on very dodgy legal ground if you do so. You need to contact your local Shelter office or CAB and seek advice from them.

                      What I would suggest you do is write to your landlord, state exactly what the problem is, and give him 14 days to respond and rectify it. Get some quotes for fixing the problem, at least three or four. If the landlord does not respond in 14 days then send a letter saying that you will contract the cheapest supplier in 7 days and rectify the problem yourself, and that the cost will be deducted from his rent, unles he states to the contrary.

                      Landlords won't do anything unless you threaten them to. We had horrendous problems with our student landlord too.
