A proposed bill states that a woman would go to jail if she failed to report a miscarriage in 12 hours. Info here (http://www.dailykos.com/story/2005/1/6/194434/1328)

erm....all i could think was "what the fuck?!?!?!" seriously though, a foetus still isnt born and therefore not anyones concern but the woman carrying it...for the time being.

"This bill, which was requested by the Chesapeake Police Department, is an attempt to reduce the number of "trashcan" babies that are born and then abandoned in trashcans, toilets, or elsewhere to die from exposure or worse. There are numerous examples of these tragic deaths in Virginia, many in Northern Virginia and also in Hampton Roads. Once the body of a child is found, if the death of that child is undetermined by a coroner, the person abandoning that child can only be charged with "the improper disposal of a human body".

from the bottom of the page. as is pointed out, that's all births and consequent deaths, not miscarriages. Outrageous.

This is reversing the progress that women have meant to have made in the last century.

People that want this are just complete prats that can't think of women as humans, and must want to fill up the prisons with people who haven't even done anything 'morally' wrong.

Can someone tell what the reason for this law is, or at least the supposed reason? It doesn't seem to be making any more sense than having to report whenever you get a papercut.

I can see an argument for encouraging women to report miscarriages - and not for sinister reasons. Miscarriages can have serious complications and are obviously very traumatic for the woman (and her partner). And it is useful to have some idea of the number of miscarriages occurring and if there is a pattern, for public health reasons.

But a prison sentence is just bizarre in the extreme. I don't really understand it.

I shan't bore you with detail, but miscarriages are not always complete and it is not unknown for retained products of conception (ie the dead baby) to be found on ultrasound when investigating subsequent infertility or menstrual problems. And then you can can get so-called molar pregnancies which are potentially cancerous, and need medical treatment.

A 12 hour deadline is ridiculous though.

But any kind of deadline is ridiculous. It should be "You don't report it, it's your loss".

So how would calling the local police station get you that medical help? It wouldn't. The best bet would be to stop by a hospital which is what the majority of women probably do anyway. Surely the hospital can record the details?

Being the everlasting sceptic when it comes to the current American climate and reproductive rights (;)) I think Cosgrove backtracked when he saw outrage caused by it. And if he was intent on referring to abandoned babies, it should have been specified in the proposed bill, given another previous bill of his was a duty to report childbirth (http://leg1.state.va.us/cgi-bin/legp504.exe?031+sum+HB1421). I don't think he was misinterprited, he was just caught.

According to another blog, in Virginia, 'foetal death' is very specific: Fetal death" means death prior to the complete expulsion or extraction from its mother of a product of human conception, regardless of the duration of pregnancy death is indicated by the fact that after such expulsion or extraction the fetus does not breathe or show any other evidence of life such as beating of the heart, pulsation of the umbilical cord, or definite movement of voluntary muscles.

Who are we to mail our used tampons to now? :(

Thats out of order iv had a miscarriage and thats the last thing your thinking about it took me three days to tell someone i was so upset, and so worried

Thats pissed me of thats totaly out of order, if that goes through il write a letter of complaint myself.
