I think they should be - whole point of safe deposit boxes is to keep things safe.

Absolutely they are. Bollocks to the notice, they have a duty of care over the contents. Finding your box termite-infested is the same thing as finding it "broken" in my opinion.

Unfortunately another side to it is that the bank wouldn't necessarily know what was in the box (often it is secret) so I am not sure how compensation would be agreed, but they definitely owe him something.
